Melodica Music Store failure to act with respect to a breach by the customer or others does not waive its right to act with respect to subsequent or similar breaches. Indemnity The customer agrees to defend, indemnify and hold harmless Melodica Music Store, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon the actions or inactions, which may result in any loss or liability to Melodica Music Store or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfilment of any of the obligations under this User Agreement or arising out of the violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this User Agreement. Intellectual property All copyright, trademarks and other intellectual property rights in all material, content or software supplied as part of our Website, including emails or any other form of communication with the customer is protected by international copyright and database right laws and shall remain at all times vested in Melodica Music Store or, where relevant, its franchisors/licensors. The customer is permitted to use this material only as expressly authorised by Melodica Music Store or its franchisors/licensors. If the customer use the Website, the customer is responsible for maintaining the confidentiality of The Account and Password and for restricting access to the computer, and the customer agree to accept responsibility for all activities that occur under The Account or Password. Melodica Music Store shall not be liable to any person for any loss or damage which may arise as a result of any failure by the customer to protect the password or account. If the customer knows or suspects that someone else knows the password, the customer must contact the Customer Care team at info@melodicamusicstore.com If Melodica Music Store has reason to believe that there is likely to be a breach of security or misuse of the website, Melodica may require the customer to change the password or Melodica may suspend the account without any liability to Melodica.
